Who Qualifies for Family-Based Immigration?
These visas are meant to help those who are not earning a primary income for the family.
If you are a U.S. citizen over the age of 21, you can sponsor the following immediate relatives:
- Your spouse
- Your unmarried children under the age of 21
- Your parents
- An orphan you adopted in a foreign country
- A foreign-born orphan to be adopted in the U.S.
You can also sponsor the following family members, but they will not have the same preference in obtaining a visa as immediate family members listed above:
- Unmarried sons and daughters aged 21 and above
- Married sons and daughters
- Siblings aged 21 and above
Lawful permanent residents (green card holders) may sponsor:
- Unmarried children under the age of 21
- Unmarried children 21 and older
U.S. citizens can also sponsor a foreign-born fiancé(e) as well as his or her child through a K-1 visa to allow for your marriage in this country within 90 days. This visa does not grant lawful permanent residency, and you must fulfill all requirements.
